Welcome to ArtVybe Marketplace (the “Platform”), an online marketplace for the creation, sale, purchase, and trading of non-fungible tokens (NFTs). By accessing or using our Platform, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, you may not use the Platform.
Prohibited Content: You may not create, upload, list, mint, or share any NFTs, collection metadata, profile images, or other content that is:
Content Removal: We reserve the right to remove, delist, or otherwise make unavailable any content, including NFTs and collections, that we reasonably believe violates these Terms or is otherwise inappropriate, at our sole discretion and without prior notice. Because NFTs exist on a public blockchain, removal from the Platform does not and cannot remove the underlying on-chain token.
User Responsibility: You are solely responsible for the content you create, upload, mint, list, or share on the Platform, including ensuring it complies with these Terms and all applicable laws.
You agree to use the Platform in a manner that is lawful, ethical, and in accordance with these Terms. Prohibited activities include, but are not limited to:
We operate a moderation programme combining proactive review, user reports, and automated checks. Content that violates these Terms, including content deemed vulgar, obscene, infringing, illegal, scam-related, or otherwise inappropriate, will be removed at our sole discretion.
When a collection is removed from the marketplace, we may:
Removal from the Platform does not affect the existence of the NFT on the underlying blockchain. We cannot delete on-chain tokens; we can only stop displaying or facilitating trade of them on this Platform.
Every collection and NFT on the Platform has a “Report” control. Any registered user may report content they reasonably believe violates these Terms. Reports are reviewed by our moderation team in the order they are received, with illegal content categories (e.g. CSAM, terror, non-consensual intimate imagery) prioritised ahead of all others.
When filing a report, please:
False or malicious reports: Submitting reports in bad faith, in coordinated campaigns, or to harass another user may result in your reports being deprioritised, restrictions on your reporting privileges, or account suspension. We do not disclose the identity of reporters to reported parties; we may share report data with law enforcement under legal process.
Copyright (DMCA): If you believe content on the Platform infringes a copyright you own, you may submit a written notice that includes (i) your physical or electronic signature; (ii) identification of the copyrighted work; (iii) identification of the material claimed to be infringing and sufficient information for us to locate it (collection address, chain, and token id); (iv) your contact information; (v) a statement that you have a good-faith belief that use of the material is not authorised; and (vi) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act on the owner's behalf. Send notices via the in-product report flow with reason “Copyright / trademark infringement” or to the contact channel published on our website. We may, in our discretion, remove the reported content while we review and may forward your notice to the alleged infringer.
Counter-notice: If your content was removed and you believe it was removed in error or misidentification, you may submit a counter-notice to the same contact channel with equivalent information and a statement under penalty of perjury that you have a good-faith belief the content was removed by mistake.
Repeat infringers: Accounts that are the subject of multiple sustained infringement reports may be terminated.
Illegal content reporting obligations: Apparent CSAM is reported to NCMEC and law enforcement as legally required. We may preserve relevant data (without disclosing it publicly) to comply with legal hold requests, court orders, or regulatory obligations.
